Is this Legal?

The short answer is YES!

In Connecticut, the state has decided to leave the decisions of allowing consumption largely to property owners while maintaining Connecticut’s “Clean Indoor Air Act”. The State further clarified laws concerning cannabis in a June 2021 special session of the General Assembly. The general summary is; property, as well as business owners, can allow consumption on their property at their discretion. There is no use of cannabis allowed on any state land or water properties managed by DEEP (Department of Energy and Environmental Protection). Each town also has the ability to enact ordinances for their residents, but has deferred to the State guidelines in almost every instance. What is the “Clean Indoor Air Act”?


General Statute Sec.19a-342 protects citizens from the health risk associated with secondhand smoke.

  • This expanded the definition of “smoking” and “vaping” to include any tobacco, hemp, and cannabis

    • It also clarified the “area” where smoking is prohibited now includes both the interior of buildings (facilities, businesses, workplaces) AND the outside area within twenty-five feet of any doorway, operable window, or air intake vent of the facility, building or establishment

      What Happened in June 2021?


  • Senate Bill No. 1201, June Special Session, Public Act No. 21-1: “An act concerning responsible and equitable regulation of adult-use cannabis.” With regards to smoking or vaping any product, these are the key points to be aware of:

  • Owners of any space can legally make their property tobacco free inside and outside

  • Smoking is now banned in ALL rooms offered to guests of hotel, motel, or similar lodging (previously 25% of rooms could allow smoking)

  • Entryways to ALL buildings should be smoke free. The recommended distance for smoking should be 25-50 feet away (25 feet minimum required) from openings including doors, operable windows and vents


  • That's it! If any venue is ok with consumption on their property, these are the guidelines smokers need to be considerate of to stay with the law.
